The Environment Protection and Resources Conservation Committee of the National People's Congress of P.R.C.
The Environment Protection and Resources Conservation Committee of the NPC is a specialized committee subordinated to the NPC. It is a permanent-working organ of the NPC to exercise, under the leadership of the NPC, its functions and powers in the field of environment and resources protection legislation and supervision and to study, draft and deliberate relevant proposals. When the NPC is not in session, it is subject to the leadership of the Standing Committee of the NPC.
The main tasks of the Environment Protection and Resources Conservation Committee of the NPC involve three aspects: the first is legislation and supervision work related to protection and control of environmental pollution, the second is legislation and supervision work related to ecological environment protection and the third is legislation and supervision work related to natural resources protection.
Functions of the Environment Protection and Resources
Conservation Committee
The functions of the Environment protection and Resources Conservation Committee of the NPC are as follows:
1. To deliberate proposals related to environment and resources protection delivered by the Presidium of the NPC or the Standing Committee of the NPC and other relevant proposals.
2. To submit to the Presidium of the NPC or the Standing Committee of the NPC proposals related to environment and resources protection which are within the scope of respective functions and powers of the NPC or the Standing Committee of the NPC.
3. To organize the drafting of draft laws and relevant proposals related to environment and resources protection in accordance with the legislation plan of the Standing Committee of the NPC, to deliberate the draft laws related to environment and resources protection which are drafted by relevant departments of the State Council and delivered by the Presidium of the NPC or the Standing Committee of the NPC and submit report on deliberation.
4. To deliberate, upon delivery by the Standing Committee of the NPC, relevant administrative regulations, decisions and orders related to environment and resources protection of the State Council: orders, instructions and regulations related to environment and resources protection issued by the Ministries and Commissions of the State Council; local regulations and resolutions related to environment and resources protection formulated by the People's Congresses and their Standing Committees of the Provinces, Autonomous Regions and Municipalities, as well as decisions, orders and regulations relating to environment and resources protection made by the People's Governments of the Provinces, Autonomous Regions and Municipalities which are regarded as being contradicted to the Constitution and laws, and to submit report on deliberation.
5. To deliberate the inquires concerning environment and resources protection delivered by the Presidium of the NPC or the Standing Committee of the NPC, to hear the replies given by the state organs which are addressed with the inquires and to submit report on deliberation to the Presidium of the NPC or the Standing Committee of the NPC when necessary.
6. To deliberate relevant general and specific policies and contents concerning environment and resources protection in the national and social economic development programmes and plans delivered by the Standing Committee of the NPC; to study, upon delivery by the Standing Committee of the NPC, major state development and construction projects which will have great impact on the environment and to submit report on deliberation and study.
7. To assist the Standing Committee of the NPC to exercise supervision over the enforcement of environment and resources protection laws and over the work related to environment and resources protection being done by the State Council.
8. To conduct investigations and researches on relevant issues related to environment and resources protection which are within the scope of respective functions and powers of the NPC or the Standing Committee of the NPC and to submit proposals.
9. To strengthen, in accordance with the guiding principles and unified arrangement of the Standing Committee of the NPC, intercourse and cooperation with foreign parliaments and relevant international organizations in the field of environment and resources protection, with a view of promoting understanding and friendship.
10. To fulfill other relevant duties entrusted by the NPC and its Standing Committee.
